The Texas legislature has specifically defined the term "intoxication" as it relates to DWI cases. There are two definitions: Impairment of mental or physical faculties by the existence of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or having an alcohol concentration of 0.08 or more.

When drivers under the influence of alcohol have a 0.08 BAC, their critical driving skills, like judging distance and speed, steering, visual tracking, concentration, braking, and staying in driving lanes, are severely impaired. In Texas, drivers with a BAC of more than 0.08 are subject to a 90-day suspension of their driver's license as long as they have not had any other drug or alcohol-related offenses in the past ten years. Drivers with prior alcohol-related offenses will receive a suspension of their driver's licenses for at least one full year.
